1. Who you are contracting with

thepowedeedit.com is operated by The Powede Edit LTD (RC 9692440), established in Nigeria, at E5 Finima Close, Cowrie Creek Estate, Ikate, Lekki, Lagos. In these terms, “we”, “us” and “The Powede Edit” mean that business, and “you” means the person placing the order.

These terms apply to every order placed through this site. The Refunds, Returns & Exchanges Policy, the Shipping & Delivery Policy and the Privacy Policy form part of them.

2. Who can buy

You must be at least 18 and legally able to enter a contract. By placing an order you confirm that you are, and that the details you give us are accurate and yours to give.

3. The pieces

The Closet Edit and Luxe for Less are preloved. Each piece is a single item, previously worn, and sold in the condition described on its listing: a condition grade, condition notes where there is something to note, and measurements taken from the garment itself. Honest wear consistent with that description is the product, not a defect.

The Collab is brand new stock and is described as such. Different return rights apply, and they are set out in the Refunds, Returns & Exchanges Policy.

Photographs are taken as faithfully as we can manage, but colour reproduces differently on different screens, and a slight variation in shade is not a fault. Sizes are quoted as the garment's own label reads, which is why measurements are published: where a label and a measurement disagree, trust the measurement.

4. Prices and delivery fees

Prices are in Nigerian Naira and include any tax we are required to charge. The delivery charge that applies to your order is shown with the total at checkout before you pay. Nothing is added after that point.

Customs duties and import taxes on international orders are not included and are payable by the recipient. See the Shipping & Delivery Policy.

If a piece is listed at a manifestly incorrect price and the error is obvious, we may cancel the order and refund you in full rather than supply at that price. We will tell you before we do it.

5. Holds

Placing a hold takes a piece off sale for 15 minutes so that you can complete checkout without losing it to someone else. A hold costs nothing, commits you to nothing, and creates no contract.

• A hold expires automatically after 15 minutes. The piece then returns to sale and anyone can buy it, including you.
• You may hold a limited number of pieces at once. This is to stop one browser removing the whole shop from sale.
• Where payment lands after the hold has already lapsed and the piece has gone, the payment is refunded in full. This is the one case where we refund a preloved piece as a matter of course.

6. When the contract is formed

Your order is an offer to buy. The contract between us is formed when your payment is confirmed by our payment provider and we send you an order confirmation email. Until that moment we may decline the order, and we will refund anything already taken.

Because every piece is one of one, we may have to decline an order where the piece has already sold. Where that happens you are refunded in full.

7. Payment

Payment is taken through Paystack, by card, bank transfer or USSD. Your card details are entered on Paystack's payment page and never reach us. Paystack's own terms govern the payment instrument itself.

Title to a piece passes to you when we receive payment in full. Risk in the piece passes to you on delivery.

8. Delivery

Processing and transit times, shipping fees, customs, tracking, failed deliveries and lost parcels are covered in the Shipping & Delivery Policy. Delivery estimates are estimates, not guarantees, unless a guaranteed service has expressly been purchased.

9. Returns and refunds

Preloved pieces in The Closet Edit and Luxe for Less are final sale. Brand new pieces in The Collab may be returned within 14 days on the conditions set out in the Refunds, Returns & Exchanges Policy.

Whichever section a piece came from, if it arrives faulty, unsafe, or materially different from its listing, your statutory rights apply and we will put it right. Final sale covers change of mind. It does not cover our mistakes.

10. The foundation share

A share of the price on every listing goes to the Powede Lawrence Foundation. That share, and what the foundation does with it, is published on the Foundation page. It is a statement of how we allocate our own proceeds. It does not make your purchase a charitable donation, and it is not tax deductible to you.

11. Using this site

You agree not to:

• Use automated tools to place, scrape or hold pieces
• Place holds you have no intention of completing, in order to take stock off sale
• Interfere with the site's security, availability or payment flow
• Give false contact or delivery details

We may cancel holds or orders, and decline future orders, where we reasonably believe any of the above is happening.

12. Intellectual property

The photography, written listings, provenance stories and design of this site belong to The Powede Edit and may not be reproduced commercially without permission. Brand names and trade marks referred to on listings belong to their respective owners, and are used only to identify the piece being sold.

13. Our liability

We do not exclude or limit our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else which cannot lawfully be excluded, including your rights under the Federal Competition and Consumer Protection Act 2018.

Subject to that, our total liability arising out of an order is limited to the amount you paid for that order, and we are not liable for indirect or consequential loss, or for loss of profit, opportunity or goodwill.

14. Events outside our control

We are not liable for delay or failure to perform where it is caused by something outside our reasonable control, including courier disruption, customs, severe weather, industrial action, civil unrest, or failure of a payment or hosting provider. Where a delay is substantial we will contact you, and you may cancel an undelivered order for a full refund.

15. Privacy

What we collect, why, who processes it and how to have it corrected or erased is set out in the Privacy Policy.

16. Changes to these terms

We may update these terms. The version that applies to your order is the version published at the time you placed it. The date at the top of this page is the date of the current version.

17. Governing law

These terms and any dispute arising from them are governed by the laws of the Federal Republic of Nigeria, and the courts of Lagos State have jurisdiction. If you buy as a consumer resident elsewhere, this does not deprive you of the protection of mandatory consumer law in your own country.

Complaints may also be made to the Federal Competition and Consumer Protection Commission (FCCPC) at fccpc.gov.ng.
